Brinkhof wins Impact Case of the Year Award for the Netherlands

Brinkhof has received recognition at the Managing IP Awards for its role in the Sisvel v Xiaomi litigation before the Netherlands Court of Appeal. The Awards were presented in a virtual ceremony on March 30 2021.

The firm successfully represented Xiaomi in a high-profile infringement dispute concerning standard essential patents (SEPs). The District Court of The Hague rejected Sisvel’s preliminary injunction request and declared the SEP non-essential. The firm also defended OPPO against Sisvel.

In its judgment, published in April 2020, the Court of Appeal examined EU law and held that a preliminary injunction was disproportionate in an SEP/FRAND licensing dispute.

The award citation also recognizes other patent work the firm has handled in the past year. This includes advising Heineken on a patent dispute over a bottle-in-bottle technology, which resulted in a global settlement, and acting in complex EPO proceedings on behalf of clients such as Tata Steel and the Broad Institute.
